Webinar: Insights on New Treasury Guidance for Apprenticeship and Davis-Bacon Mandates on Private Clean Energy Projects

ABC will provide information on guidance recently released by the U.S Department of Treasury and Internal Revenue Service regarding implementation of the Inflation Reduction Act’s apprenticeship and prevailing wage requirements for contractors who build clean energy projects.

Problematic language in Subtitle D-Energy Security of the IRA generally slashes longstanding and current tax credits from 30% to a baseline credit of 6% for the private development of solar, wind, hydrogen, carbon sequestration, EV charging stations and other clean energy projects. However, the IRA gives developers a bonus tax credit that is 500% higher than the baseline credit if they require project contractors to pay construction workers union-scale, government-determined hourly wages and benefits and use apprentices enrolled in government-registered apprenticeship programs. In most cases, both conditions must be met to qualify for the bonus rate.

Baskin and Brubeck will discuss key aspects of the newly released guidance and what clean energy contractors should know to ensure compliance.

Meet the Speakers
Maury Baskin
serves as ABC General Counsel and is a shareholder in the Washington, D.C., office of Littler Mendelson P.C., where he co-chairs Littler’s Workplace Policy Institute. He is one of the chief legal advocates for the rights of employers on labor issues throughout the country. Baskin has represented ABC and its member firms at every level of court, up to and including the U.S. Supreme Court.

Ben Brubeck is vice president of regulatory, labor and state affairs at the Associated Builders and Contractors. A recognized expert in procurement, labor and employment issues impacting the construction industry, Brubeck has extensive experience with the Davis-Bacon Act, state prevailing wage laws, project labor agreements and regulations affecting federal contractors. He also serves as vice president of policy for the National Council for Public-Private Partnerships.

Nathaniel Peniston
is vice president at The Contractors Plan where he works with external partners such as ABC to identify areas of collaboration and drive customer success. An expert in the administration and compliance challenges of hourly employees with prevailing wage and fringe benefits obligations, Peniston has published a number of articles, including “Why ‘Prevailing Wages’ Exist & How to Take Advantage of Them,” and a book, The Contractor’s Guide to the Davis-Bacon Act: Essential Knowledge for Bidding and Compliance on Prevailing Wage Jobs.
